When is "Special Process Servers" needed?


By and Large most Civil Papers, Criminal Subpoenas, Judgments, and Orders issued by the Court are served by the Civil Unit of the local Sheriff.

These Papers are filed with the Clerk and distributed to the Deputies for Service. Service of these Papers is usually attempted Monday through Friday between the hours of 8:00 AM and 5:00 PM. Unless otherwise commanded by the Sheriff but never on weekends. Some larger Counties have a Civil Unit that works evenings making completion of Service more likely. Most people work during daylight hours and are not home. A Deputy will make several trips and then return the Paper as not servable .

In most instances because of urgency and time restraints an Attorney with an important case must get his witnesses served within a reasonable time. Ideally, 72 hours before the hearing, but in Georgia a process for a court appearance may be made up to 24 hours before the hearing. This is when an Attorney will find it necessary to use a Private “Special Process Server”. A Motion and Order for this appointment is necessary when it is shown that a paper has been declared undeliverable or that because of the constraints of time it is necessary to use a Private Civilian for serving.

Also, In many instances an individual attempts to dodge service for one reason or another. Because of his workload, a Deputy will not invest any time in surveillance or locating other addresses ( Work, Friends, Houses, Hangouts, Etc. ) where the person can be served. This is when a “Special Process Server” is utilized most. Armed with numerous possible addresses, vehicle descriptions, favorite bars and lounges frequented, work out and gym locations, Etc. an experienced server will complete service by leg work and instinct. When the outcome of an important case with sometimes millions of dollars at stake and the calendar date is drawing near an Attorney can’t gamble his case on a Government Agency that could care less whether a Plaintiff or Defendant is served or not. The completion of service by a private professional Process Server not only makes him a valuable tool for the Attorney but word spreads throughout the Legal Community that certain individuals get the job done. This separates a Professional Process Server from a delivery man that knocks on the door and when there is no answer returns to his car a leaves. Many times by just “Sitting On” an address a service is completed or by checking out the work address at different times of the day. Completion of service gets us paid. Pure and Simple.
